1) INTRODUCTION
Manjha Technologies private limited is a private company registered under The Companies Act, 2013 with its registered office located at 6-A, M.C. Colony, Near Bharat Mata Mandir, Hisar. Manjha Technologies provide a collection of online resources which include classified advertisements on the mobile application or website. By using the Service, you agree to comply with these Terms. These Terms may be updated by MANJHA TECHNOLOGIES at any time at its sole discretion. MANJHA TECHNOLOGIES may send you a notice of changes to the platform or the Terms. If any user will translate of the English version of the Terms into other languages, you understand and agree that any translation of the Terms into other languages is for your convenience only and that the English version governs the terms of your relationship with MANJHA TECHNOLOGIES. Furthermore, if there are any inconsistencies between the English version of the Terms and any translation, the English version of the Terms shall govern.
2) DEFINITIONS
a) MANJHA/MANJHA TECHNOLOGIES/Owner/WE: Manjha Technologies private limited and its branches directly or through a hyperlink or any other mode of access, the creator and publisher of the Website and the Mobile Application, its employees and other affiliates.
b) Services: MANJHA TECHNOLOGIES Mobile Application and Manjha Technologies.com and any other related domain/mobile application developed/created/published by the Owner.
c) Platform: Any classified ads/post/content/information/posted/linked/published/transmitted/ shared by user on/through/with MANJHA TECHNOLOGIES mobile application and www.manjha.in and any other related domain/mobile application developed/created/ published by the Owner.
d) You/User/Client: You/User/Client means any legal person/entity who is accessing the platform through any electronic media. The terms “Your/Yours” shall be construed accordingly.
e) Your Information: Any information/data/content furnished or provided by you/ user or client on the platform or to us and other users of the platform during any such process including but not limited to registration, posting of any classifieds, discussions, chat with any user and feedback.
3) EXPLANATION OF SERVICE AND CONTENT POLICY
a) We act as a venue to allow our users to offer, sell, and buy products/ livestock and services listed on the platform. Although, you may be able to conduct payment and other transactions through the platform, using third-party vendors. MANJHA is not in any way involved in such transactions. You, hereby, acknowledge and agree that MANJHA is not a party to such transactions, has no control over any element of such transactions, and shall have no liability to any party in connection with such transactions.
b) You understand that MANJHA does not control, and is not responsible for ads, directory information, business listings/information, messages between users, You acknowledge and agree that you are responsible to bear all risks associated with the use of any Content, and that under no circumstances MANJHA will be liable in any way for the Content or for any loss or damage. You acknowledge and agree that MANJHA cannot and does not pre-screen or approve any content, but that MANJHA has the right, in its sole and absolute discretion, to refuse, delete or move any content for any reason or no reason without any communication/ information and justification to the user(s). Furthermore, the Platform and Content available through the Platform may contain links to other third-party websites which are completely unrelated to MANJHA. If you link to Third Party websites, you may be subject to those Third Party Websites’ terms and conditions and other policies. MANJHA makes no representation or guarantee as to the accuracy or authenticity of the information contained in any such Third-Party Website.
c) MANJHA does not provide platform for the purchase/sale and any activity relates to animals banned under The Prevention of Cruelty to Animals Act, 1960 and Wildlife Protection Act 1972 or any other laws that have been implemented to prevent cruelty to animals and protection thereof. If you commit such act against the said laws, you will liable to statutory proceedings under these laws or under other laws of state. MANJHA hold no responsibility for the said acts.
d) You acknowledge and agree that in any dispute between MANJHA users, our platform does not fall under the category of “consumers” under the provision of Indian Consumer Protection Act 1986, because we are providing only platform to users for purchase/sale/aqua consultant and not selling/buying any product itself, hence the person who deals with platform will be treated as The customers/service receivers and shopkeepers/service providers themselves and solely responsible under the principal of ‘Caveat Emptor’. Therefore, we are not directly or indirectly liable in any kind of dispute whether monetary or not.
e) You acknowledge and agree that MANJHA will not be responsible for the damage caused to the livestock and its derivatives by following/not following or following incorrectly the advice by aqua consultant, any other expert or any other user on the platform.
4) USER OBLIGATIONS
a) You acknowledge and agree not to violate any laws or regulations.
b) You acknowledge and agree to provide the true and accurate details like but not limited to the name, address, email Id, phone number / mobile number, password, phone number in order to create an account to use the services of the platform.
c) Users agree not to post/publish/upload/link/list any content/information/ads that is copyrighted or patented, protected by trade secret or trademark or any other intellectual property of MANJHA, unless you are the owner of such rights or have permission or a license from their rightful owner to post the material and to grant MANJHA all of the license rights granted herein.
d) Users agree to post/list their contents/advertisements in the proper categories only according to the options available on the platform.
e) Users confirm that the content/information/ads posted/listed by them are not consisting of any material that in any way support/encourage/promote views including but not limited to bigotry, racism or abhorrence based on caste, religion, class, gender, age, race, language, lifestyle preferences, and nationality and / or is being scurrilous, slanderous to any third party.
f) Users agree not to post/publish/upload/link/list that is harmful, abusive, unlawful, threatening, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libellous, invasive of another's privacy or other rights, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or illegal gambling or harms or could harm minors in any way or otherwise unlawful in any manner.
g) Users agree not to post/publish/upload/link/list that includes personal or identifying information about another person without that person's explicit consent.
h) Users agree that they possess the lawful ownership of the product/ goods and/ or services they are listing/ posting on the Website and/or the Mobile Application. By posting/ listing their products/ goods and/ or services on the Website and/ or the Mobile Application, the Users confirm the rights to do so and they are solely responsible for the content of their posts. Users shall not post or list any products, services, or goods of which they are not lawful owner or do not have the authority or consent to do so from the owner/ proprietor of the products/ goods and/ or services.
i) Users confirm that the ads and/ or classifieds posted/ listed by them do not contain any type of pornographic material including but not limited to child pornography and/ or suggestive material or any sort of indecent representation of any individual including women according to The Indecent Representation of Women (Prohibition) Act, 1986 (Act No. 60 of 1986).
j) Users confirm that the ads and/ or classifieds posted/ listed by them do not involve the purchase and/or selling of goods/ products which are illegal, counterfeit, stolen or unlawful in the nature.
k) Users confirm that the ads and/ or classifieds posted/ listed by them are not propagating any spam, multifarious/ chain letters, and pyramid/ multi-level marketing schemes in any of its forms.
l) Users confirm that the ads/content posted/linked/listed by them are not contains software viruses/malware or any other computer code, files or programs, other form of technology designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or any other computer resource or the property of other Users or imposing unreasonable amount of load on platform infrastructure or interfering with the proper functioning of platform.
5) PAID SERVICES
We may charge a fee to utilize some areas of the Service (“Paid Services”). Currently, we offer the following kinds of features for Paid Services depending on your usage, category, geographical location and medium of purchase. The terms of Paid Services and the relationship between “Client” and “MANJHA India” shall be governed by the laws of India. Any claim you may have against MANJHA must be submitted to the exclusive jurisdiction the courts of Hisar, Haryana. We reserve the right to modify the price at which these features are made available to you.
6) PAYMENT FOR PAID SERVICES
Upon selecting any feature of Paid Services, you may be redirected to a third-party payment processing site offering payment through various channels such as net banking, debit card and credit card (“Payment Gateway”). MANJHA may offer you a right to pay through cash or other channels such as cash collection. You agree that Paid Services will be made available to you only upon receipt of payment confirmation from the Payment Gateway or collection agencies. Upon making payment to us, through any medium whatsoever, you warrant to us that you are entitled to use the medium or otherwise make the payment to us under applicable law.
7) REFUNDS/CANCELLATION FOR PAID SERVICES
If you choose to delete or deactivate any Paid Services prior to the period for which it is active, we will not be liable to refund you for any unutilized time.
8) REFUNDS/CANCELLATION FOR GOODS PURCHASED
a) Once the order is placed the company has zero/ no refund policy. Refund will be initiated if the product is not delivered in 30 business days.
b) Once the order is shipped and user/customer refuse to accept the order it will tantamount that order has been successfully delivered and in that case no refund will be issued.
c) All orders placed on Manjha will be delivered through our logistic partners.
d) Orders received will be processed in due course of time and once the order is shipped a notification sms/mail will be sent on sms/mail/whatsApp.
e) Delivery time is generally 5-7 business days however in remote locations it may increase from 5-7 days to 10-12 days. However due to MRP changes, technical glitches, weather conditions, unavailability of product we are not able to deliver product then appropriate refund will be initiated.

9) USER SUBMISSIONS
You understand that when using the Platform, you will be exposed to content from a variety of sources and that MANJHA is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such content, and you agree and assume all liability for your use.
10) INDEMNITY
The User should agree to indemnify and hold MANJHA, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of content submitted by the user, users use of the service, violation of the Terms of use, breach by the user of any of the representations and warranties herein, or user’s violation of any rights of another.
11) LIMITATION AND TERMINATION OF SERVICE
You acknowledge that your account is identified and linked through your mobile number, Facebook account or email address through which you have registered. In the event you have more than one account linked through your mobile number, Facebook account or email address, MANJHA reserves the right to remove or restrict the usage of such duplicate accounts. You acknowledge and agree that MANJHA reserves the right at any time to modify, limit or discontinue the Service (or any part thereof) with or without notice and that MANJHA shall not be liable to you or to any third party for any such modification, suspension or discontinuance of the Service. You acknowledge and agree that MANJHA, in its sole and absolute discretion, has the right to delete or deactivate your account, block your e-mail or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any Content, for any reason or no reason at all, including, without limitation, if MANJHA believes that you have violated these Terms. Further, you agree that MANJHA shall not be liable to you or any third-party for any termination of your access to the Platform or the Service. Further, you agree not to attempt to use the Service after any such termination.
12) WARRANTIES
You acknowledge and agree that use of the platform and the service is entirely at your own risk and that the platform and the service are provided on an "as is" or "as available" basis, without any warranties of any kind. MANJHA makes no warranties or representations about the accuracy or completeness of the content or the content of any third-party websites linked to the platform and assume no liability or responsibility for any errors, mistakes, inaccuracies of content, personal injury or property damage, bugs, viruses, Trojan horses. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.
13) LIMITATIONS OF LIABILITY
You agree not to hold MANJHA or any of its officers, employees, agents responsible or accountable for any of your listing, postings or information and nor shall we, our officers, employees or agents be liable for any misuse, illegal activity or third party content as most postings, listings or information are generated by various users directly and we do not have any role in the creation, publication or distribution of the posting, listing or information, nor are we in a position to have editorial control over the substance or content contained in the listings, postings, or information.
You understand and agree that we do not guarantee the accuracy or legitimacy of any listing, posting, and information by other users. You further agree that we are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of the site or as a result of any sale, purchase of goods/pets/livestock and services with other users of the site. We also cannot guarantee continuous or secure access to our Services. Accordingly, to the extent legally permitted we exclude all implied warranties, of merchantability, fitness or quality of the platform and our services. MANJHA makes no representations or warranties that the platform is appropriate for use in other locations. Those who access or use the platform from other jurisdictions do so at their own volition and risk and are responsible for compliance with local law.
14) ELIGIBILITY TO ACCEPT TERMS OF SERVICE
This Platform is intended only for adults and that you are eligible to contract as per applicable laws. If you are using/accessing this Platform as a representative of any person/entity, you acknowledge that you are legally authorized to represent that person/entity. Minors, i.e. users of under 18 years of age, are only allowed to access the Platform and use the Service, in the event of approval of their legal representatives.

Access and use of the App/Website is subject to the Terms and Conditions ("Terms") accessible on the Website.
Manjha Technologies Private Limited, a private limited company with its office at DSS 129/130, Urban Estate II, Hisar -125001, Haryana, India. (hereinafter shall be referred to as “Company”, “Manjha”, “We”, “Us”, “Our” and terms of similar meaning).
The Company owns and operates its apps available at Google play store & Apple App store as well as website available at https://manjha.in/ (referred to as “Website”) providing information on the Company and on services offered etc. This Privacy Policy does not apply to the websites of our business partners, corporate affiliates or to any other third parties, even if their websites are linked to the site. We recommend you to review the respective privacy statements of the other parties with whom you interact.
By accessing the Apps/Website or otherwise using the Apps/Website, you (hereinafter referred to as “You”, “Your”, “User”, “Guest/s” as applicable) expressly consent to Our collection, storage, use, and disclosure of the Information (as defined hereunder) in accordance with the terms of this Privacy Policy.
As we update, improve and expand the Apps, this Privacy Policy may change at Our sole discretion without notice, so please refer back to it periodically as You will be deemed to be governed by the terms of such modified Privacy Policy, as it comes into effect from time to time. By using Our Apps, you are deemed to have read, acknowledged, and accepted all the provisions stated in this Privacy Policy, including any changes that we may make from time to time. We host the Platform in a secure server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders.
6) LINKS TO THIRD PARTY SITES
The Platform may include links to third-party applications / websites / Platforms (“Third Party Sites"). Such Third-Party Sites are governed by their respective privacy policies, which are beyond Our control. Once You leave our Platform, the use of any information You provide is governed by the privacy policy of the operator of the Third Party Site You are visiting. That policy may differ from Ours. If You can't find the privacy policy of any of these Third Party Sites, You should contact the relevant Third Party Site directly for more information.
We do not provide any Personal Information or personally identifiable information to third-party
websites/advertisers/ad-servers without Your consent.
7) ADVERTISING
We use third-party service providers to display ads on Our behalf across the internet and sometime on this Platform. They may collect anonymous information about Your visits to Our Platform. They may also use information about Your visits to this and other websites to target advertisements for goods and services.
This anonymous information is collected through the use of a pixel tag, which is a standard technology used by most major websites in the industry. No personally identifiable information is collected or used in this process.
8) YOUR CONSENT
By using the Platform and/or by providing Your Information, You consent to the collection and use of such information in accordance with this Privacy Policy, including but not limited to Your consent for sharing Your Information as per this Privacy Policy. You specifically agree and consent to us collecting, storing, processing, transferring and sharing information (including Personal Information) related to You with third parties, professionals, or registered business partners/users for the purposes as set out in this Privacy Policy.
